By accessing or using the services provided by Darkaa, including our website (https://darkaa.com), Trak platform (https://admin.trak.codes), and our Google Sheets and Google Forms add-ons (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.
2. Description of Services
Darkaa provides a QR code tracking and automation platform (Trak) and related Google Workspace add-ons. Our Services may be subject to additional terms or product requirements as specified on our website or in separate agreements.
3. User Accounts
3.1. To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. Intellectual Property Rights
5.1. The Services and their entire contents, features, and functionality are owned by Darkaa, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as incidental to normal web browsing or as expressly permitted in writing by Darkaa.
6. Payment Terms
6.1. Certain aspects of the Services may be provided for a fee. You agree to pay all fees associated with the Services you purchase.
6.2. Fees are non-refundable except as required by law or as explicitly stated in a separate agreement.
7. Termination
7.1. We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
7.2. Upon termination, your right to use the Services will immediately cease.

The Services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.
9. Limitation of Liability
In no event shall Darkaa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
10. Indemnification
You agree to defend, indemnify, and hold harmless Darkaa and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of your use and access of the Services, or your violation of these Terms.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of TOGO, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page.
